UK law and modafinil ban in 2016-2017-2018

The Misuse of Drugs Act 1971 governs controlled drugs, and the Health Act 2006 provides additional measures and further regulations.

This is where the waters become muddy; according to UK law Modafinil is not a controlled drug in the United Kingdom, and so does not require a prescription for purchase. However, to complicate matter, it is not approved by the MHRA (which is the UK’s equivalent of the FDA).

With all of these laws, Modafinil is put into a grey area, thus it is legal for British people to buy modafinil online  for personal use, without prescription. However, personal use is defined as an amount that is less than a three month supply or less.

The drug is not allowed to be imported for commercialization or sale but as long as the drug is for personal use only, its importation is considered legally acceptable.

Most people have no problem ordering internationally and overseas, but there have been spotty reddit reports of Modafinil being seized and inspected at the border. This is a minor outside risk however and most orders should get through without incident.

After The UK Psychoactive Substances Act 2016 has been released, we have found Modafinil is “among medical products “ since it is approved in the UK for treating ADHD, ADD and narcolepsy. Thus modafinil is nohow affected with this act and is still in the “non-regulated” area as it was before however possession of the drug may be illegal in 2017 and 2018. According to Psychoactive Substances Act possession of any kind of psychoactive substance could be considered as not legal. That means that according to UK law one can import modafinil but could be caught if face a police stop for another reason.
